Three Meadows Terms and Conditions


Please read these Terms and Conditions ("Agreement") carefully before using our accommodation. This Agreement sets forth the legally binding terms and conditions for guests ("Guests") and Representatives of Three Meadows ("Three Meadows") who use our accommodation home ("Property").


Acceptance of Terms By using our Property, Guests and Representatives of Three Meadows and Three Meadows Pty Ltd agree to be bound by this Agreement. If you do not agree to these terms, please refrain from using our services.


Property, accommodation means Three Meadows, 22 Sunnycrest Lane Bangalow NSW 2479


Booking and Reservations


Guests must provide accurate and complete information when making a booking or reservation request. 


Bookings at Three Meadows can be made on our website www.threemeadows.com.au or via email reservations@threemeadows.com.au.


Payment


50% payment is required to reserve your dates with a further 50% payable 60 days prior to your arrival. Your reservation will be confirmed with payment.


Cancellation policy


Deposit refundable with 60 day’s notice, no refund within 60 days.


Written notifications must be provided for all cancellations.


All cancellations will incur a $300 cancellation fee. We suggest that you undertake travel insurance.


Bond


A security bond of $3,000 will be held for Meadows House and $1500 for Meadows Cottage as a credit card pre-authorisation and processed 24-72 hours prior to your check in. Your security bond will be returned to you net of any deductions according to this agreement within 7 days of your stay.


If the whole property is booked out including our shed area the bond will be $7,000.


Check-In and Out


The rental period commences from the agreed check-in date and time and terminates on the agreed check-out date and time. Guests must adhere to the agreed-upon check-in and check-out times, unless otherwise agreed with the Three Meadows


The property has the following check-in and check-out times unless agreed in writing.


  • Check-in 2.00pm
  • Check-out 10.00am


If there are any variations to these times, you will be advised accordingly prior to check-in.


We will try to accommodate requests for an early check-in however this is subject to availability. (i.e., other confirmed bookings, cleaners available to accommodate the request, maintenance schedule) and fees may apply. Despite an early application, approval will only be granted 1-2 days prior to arrival.


You are required to contact us 1-2 working days prior to your arrival date to confirm early check-in requests. If approved these notes will be recorded in your booking details.


Rates and Charges


Are quoted in AUD and are subject to change at any time and can be viewed on our website or email enquiry to reservations@threemeadows.com.au


Rates are inclusive of GST where applicable.


If a booking presides over the following periods – Easter, Christmas and New Year, the booking must be at least 5 nights minimums.


Email Confirmation


Once your booking has been confirmed and payment has been made, you will receive an email with your booking ID number.


Property Use and Responsibilities


Guests shall treat the Property and its furnishings with care and respect.


Guests shall maintain cleanliness and leave the Property in the same condition as they found it upon check-in.


Guests shall be responsible for any damage or loss caused to the Property during their stay, and shall reimburse Three Meadows for any repair or replacement costs. 


Guests shall comply with all local laws, regulations, and any specific rules provided by Three Meadows regarding the use of the Property.


Liability


Guests and Representatives of Three Meadows acknowledge that the Property is used at their own risk.


Three Meadows shall not be liable for any injury, loss, damage, or inconvenience suffered by Guests during their stay.


Guests are advised to obtain their own insurance coverage for personal belongings and travel-related risks.


Privacy and Data Protection


The collection and use of personal data shall be governed by the privacy policy of the Property, as specified by Three Meadows. 


Guests and Three Meadows agree to the collection, use, and processing of their personal data as outlined in the respective privacy policy.


Modifications and Termination


Three Meadows reserves the right to modify or terminate the services provided through the Property at any time, with or without notice. Guests and Representatives of Three Meadows shall be bound by any modifications to this Agreement.


Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Property is located. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.


Named Guests Only


  • Reservations are for pre-agreed named guests only.
  • No weddings, schoolie’s, parties or events unless pre-organised in writing.
  • No sub-letting or hire
  • Sub-letting, conducting photographic shoots, and hiring out of the premises for photography or any other reason is not allowed, unless pre-organised in writing.
  • Guests shall not sublet, assign, or transfer their booking to any third party without the prior written consent of Three Meadows.
  • The property is for use by you and your booked guests only. No outside guests are permitted on the property without pre-approval from us. The number of occupants must not exceed the number of persons shown on your confirmation. Any increase in numbers must be agreed in advance and may incur additional fees.
  • No schoolies allowed.
  • No private functions, events or parties are permitted, unless otherwise agreed in writing prior to your arrival.
  • If a private function, event or party has been pre-approved by us prior to arrival, all guests must safely depart the property by 10.30pm or time requested.
  • In the event we do pre-approve a private function, event or party, Three Meadows can coordinate this with our event coordinator.


Noise – No Disturbance to Neighbours


To make the most of your time here and to maintain harmony with our neighbours. We encourage you to enjoy recreational activities, such as music or outdoor conversations, at a reasonable volume.


Noise restrictions in the Byron Shire area are between 10PM and 8AM.


  • No smoking or Vaping inside the properties.
  • No parties - please be sure to respect the maximum occupancy of your property
  • Quiet hours are from 10:00pm-8:00am - please keep noise down!


NSW Fair Trading Code of Conduct for the Short-Term Rental Accommodation Industry


Guests who book premises located in NSW must abide by their responsibilities and obligations under the NSW Fair Trading Code of Conduct for the Short-Term Rental Accommodation Industry. No Pets


No pets or animals of any kind are permitted at Three Meadows unless agreed in writing beforehand.


Violation of these terms will incur additional cleaning fees, deducted from your bond and may result in immediate eviction.


No Smoking or Vaping


Please do not smoke on or near either Meadows View or Meadows cottage. This includes the House deck and the cottage covered area. If you must smoke, please move a distance away from both properties. Please do not leave cigarette butts on the ground. Smoking/Vaping inside we incur a cleaning fee. 


Three Meadows Facility Rules


All guests using our facilities do so at their own risk.


You acknowledge, we take no responsibility for accidents or injuries.


No diving, running or pushing in the pool area is allowed.


Plastic drinkware is provided, please do not use glassware in the pool area. 


Disclaimers


We are not responsible for failure or interruption to power supply, water outages or services to the property for any reason beyond our control.


Your actions, conduct and safety are your responsibility of all guests. We do not condone unsafe, irresponsible or illegal actions/behaviour on or off the property, during your stay or at any other time.


As a condition of entering and/or staying at the property, you and all booked guests confirm that they understand and agree to indemnify us against any liability, damage, loss or action due to any actions, incidents, loss or injuries while within or outside of the property. Including the grounds, facilities and communal areas and structures during your stay or connected with your stay.


All bookings are made in good faith; however, we reserve the right to cancel any bookings due to unforeseen circumstances and refund you the full number of monies paid to date.


Security cameras are located around the property for your safety.


No Tenancy


This booking is not a residential tenancy agreement under the residential tenancy legislation.


You agree that regardless of your length of stay, there is no tenancy or other rights created under any landlord and/or tenant laws and there are no such laws that apply to your stay.


Parking


Each accommodation(s) has private parking and are well signposted. Parking is at your own risk, and you agree you will not make any claim against us for any damages to your vehicle regardless of how or where the damage occurred.


Key Boxes


Each accommodation has a unique Key Box code lock that requires a code, please request this from our host.


Linen


Linen, towels and pool towels are provided by the property.


Additional linen may be supplied on request during your stay. Additional fees may apply.


WIFI, Internet Access and Smart TV


The property is connected to Starlink.


Internet access and WIFI are available for all guests.


Smart TV is available in all accommodation(s) please use your personal login details to access your preferred streaming service.


Cleaning


We request that guests leave the property as it was found to avoid extra cleaning charges.


This includes washing dishes, fridge emptied, placement of rubbish in the bins provided and BBQ cleaned. The cleaners will strip bed linen, so this is not required by you.


Additional cleaning charges may apply if the walls, floors, windows and/or linen are excessively dirty.


These charges will be deducted from your credit card.


Breakages & Damages


In the event of breakages, damages or lost items, we request that you contact Three Meadows as soon as possible to report the incident.


Breakages, damages or lost items to the property which are caused by any guest and/or a guest’s visitor will be deducted from your bond or supplied credit card if the charges are higher than the bond processed.


We have a strict policy on moving items or furniture, (indoor and/or outdoor) within the property. Movements may cause unnecessary damage to items and/or to the property and can cause excess cleaning time due to increased housekeeping inventory checks for replacement of items.


Any damages or excess cleaning caused by movement of items or furniture will be deducted from your bond.


Smoking & Vapes are not permitted inside any accommodation and around communal areas and facilities.


Fire and Emergency and Evacuation


Fire Certification will comply with the DA and regular checks will be made on all required fire safety compliance with appropriate licensed technicians.

Fire exits are clearly mapped and marked.


A detailed emergency plan In the event of a fire and / or emergency, you agree to follow procedures outlined in your accommodation, compendium and instructed by management.


Personal Belongings and Lost Property


You acknowledge that we do not cover your personal belongings under our insurance policy, and therefore take no responsibility for any loss or damage of your personal property while staying at the property or left on the premises. You also agree, you will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred.


By you booking and confirming your accommodation at Three Meadows, you agree to these terms and conditions.


Changes Beyond Our Control / Force Majeure


In the event that either party is unable to perform any obligation under this agreement due to circumstances beyond their reasonable control, such as acts of God, war, terrorism, natural disasters, governmental actions, strikes, labor disputes, or any other event commonly referred to as force majeure, the affected party shall be excused from such obligation for the duration of the event.


The party affected by the force majeure event shall provide prompt written notice to the other party, describing the nature of the event and the anticipated duration of its impact on their ability to perform their obligations under the agreement. The party's obligations shall be suspended during the force majeure event, and the affected party shall make reasonable efforts to mitigate the impact of the event and resume performance as soon as reasonably possible.


If the force majeure event continues for a period of 60 days either party may terminate this agreement by providing written notice to the other party. In such a case, the parties shall be relieved of their obligations under this agreement without any further liability to each other, except for any obligations that have already accrued prior to the termination.


Entire Agreement 


This Agreement constitutes the entire agreement between Guests, Representatives of Three Meadows, and the Property, and supersedes any prior agreements or understandings, whether written or oral.

Entry Conditions


General


  1. By participating in the Three Meadows Escape Giveaway (Promotion), you will be deemed to have: (a) accepted these terms and conditions; and (b) expressly consented to our use of your personal information under the Privacy Act, Spam Act and other related communication and legislation for marketing by the promoter.

  3. The Promotion commences on the 15 February 2024 and closes on the 17 March 2024 at 11:59 PM (AEST) (Promotional Period). 

  4. Entry is open to Australian residents only, who are over 18 years of age.


How To Enter


  1. To enter this Promotion during the Promotional Period, you must enter via the form on Instagram or Facebook.

  2. Participants in this promotion are limited to one entry only.

  3. Your entry must include your name, email, postcode and any other information so requested. 

  4. This is a game of chance and skill plays no part. The Promoter’s decision is final and no correspondence will be entered into with entrants.

  5. All entries, once submitted, become the property of Three Meadows Pty Ltd (Promoter). By entering the competition, you agree to receive marketing communications from the Promoter.

  6. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Terms and Conditions. 

  7. Incomplete, ineligible or incomprehensible entries will be deemed invalid.


Eligibility


  1. Employees of the Promoter and its Related Bodies Corporate (as this term is defined in the Corporations Act) and such employees’ immediate family members are not eligible to enter. 

  2. To protect the integrity of the Promotion, the Promoter reserves the right, at its sole discretion, to verify, at any time (including after the closing of the Promotion) the validity of all entries (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits invalid, incomplete, indecipherable, or illegible entries or tampers with the entry process or uses any automated entry software or any other mechanical or electronic means to submit repeated entries.


Cheating, abuse and disorderly behaviour


  1. Any Entrant may be disqualified from this Promotion at the discretion of the Promoter for any failure to comply with these Terms and Conditions or cheating in any way such as: 
  2.  Using any cheats, hacks or other third party "helper" applications or “bots” to simulate human interaction; or 
  3. Exploiting the application in any way or using the application in any way that circumvents the purpose and conditions of the Promotion. 

  4. Abusive behaviour, including any use of harassing, negative or profane language in Entrant submissions will not be tolerated and will also constitute grounds for immediate disqualification.


Judging
 


  1. After the Promoter notifies the Prize Winners, all future correspondence will then be between the Prize Winners and the Promoter. 

  2. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any Entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions. 

  3. The Promoter reserves the right to disallow any entry and/or refuse to award a Prize where false or misleading details have been given by the Entrant. The Promoter also reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Promotion. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.


Prize Conditions


  1. The winner will be selected by means of a random draw from all entries received. The draw will be conducted, in the presence of an independent witness on 18 March 2024 at Three Meadows at 22 Sunnycrest Lane Bangalow NSW 2479

  2. The winner will be notified in writing on the 18th March 2024 and published on this webpage for a minimum period of 28 days. 

  3. Due to the flights and accommodation offered, a draw for any unclaimed prizes will take place at 11am (AEST), subject to any directions from a regulatory authority on 17 April 2024 at Three Meadows at 22 Sunnycrest Lane Bangalow NSW 2479. Any winner will be notified in writing on the same day as the re-draw date and published online on this webpage for a minimum period of 28 days. 

  4. The prize values are correct at time of printing and the Promoter accepts no responsibility for any subsequent variation in the prize value. 

  5. If any prize (or part of any prize) is unavailable, the Promoter reserves the right to substitute the prize (or part of the prize) with a prize of equal value or specification. No responsibility or liability is accepted for any variation in the value of the prizes. All prize values are in Australian dollars. 

  6. The Prize Winner and their guests are responsible for any other incidental expenses as a result of using this Prize (including but not limited to meals, transfers, transport, spending money, accommodation and other experiences and attractions visited whilst in Byron Bay NSW, insurance, bonds, taxes and travel expenses). 

  7. The Promoter is not liable for any employment leave arrangements or arrangements for dependant family members i.e. annual leave payments, babysitting, carer arrangements.

  8. You agree to comply with any reasonable directions of the accommodation venue. 

  9. The Prize Winners and their guests must conduct themselves in a responsible, respectful and professional manner and comply with the conditions of the accommodation venue. 

  10. The Prize will be provided to the Prize Winner as agreed between the Promoter and the Prize Winner. 

  11. The Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash. The Prize cannot be used to purchase gift certificates or lay-buys nor can they be re-sold. The Prize must be taken as offered in (Annex A). No modifications or exchanges will be possible. The Promoter accepts no responsibility for any variation in the value, performance or availability of any Prize.


Personal Information and Privacy 


  1. The Promoter will collect information (including Personal Information) from all entries and use it for the purposes of the Promotion and for its purposes. Entrants consent to the Promoter disclosing information, including Personal Information, to third parties for the purposes of the Promotion. By submitting an entry, Entrants agree to their entry being made available for public viewing.  Entrants acknowledge and agree that the Promoter may at any time, in its absolute discretion, remove, modify or not display entries submitted for this Promotion. This includes (without limitation) any entry which (in the sole opinion of the Promoter) is defamatory, contrary to public standards of decency or otherwise judged to be inappropriate or offensive. 

  3. The Promoter is not responsible or liable in any manner for any public content or materials posted in relation to this Promotion.

  4. By accepting the Prize, the Prize Winners and their guests consent to the Promoter using their details for promotional purposes. 

  5. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the Promotion. 

  6. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as a Prize. The Promoter is not liable for any loss suffered or sustained, to people or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by it, or its agents, in connection with the supply, or arrangement for supply, of any goods or services connected with this Promotion.

The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any Entrants or Prize Winners and their guests (including but not limited to indirect or consequential loss), or for any personal injury (including death) suffered or sustained as a result of taking any Prize, except for any liability that cannot be excluded by law.

If this Promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the Promotion or to disqualify any individual who has tampered with the entry process. 

  9. Under Privacy law, Entrants may access Personal Information that the Promoter holds about them and seek correction of that information at any time.   1. The Promoter, together with Promotional partners Uniqua Collections and Eadie Lifestyle may, for an indefinite period, unless otherwise advised, use your personal information (such as name, age, mobile phone number, email address) and any other information provided to the Promoter pursuant to this Promotion without remuneration or compensation to you for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you and promoting its business and related companies. 


Limitation of Liability 


  1. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion. To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again. 

  2. The Promoter may modify or suspend the Promotion if all entrants participating in the Promotion until that point are notified of the changes to these Conditions of Entry, upon notification of any such changes, the affected entrants may terminate their participation in the Promotion without any liability to the entrant; or terminate or cancel the Promotion. The Promoter will not be liable for any modification, suspension, termination or cancellation.   

  3. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


Exclusion of liability 


  1. By registering for this Promotion each Entrant, Prize Winner and their guests assumes sole liability for any personal injury and/or damage to property caused or claimed to have been caused to them as a result of or in connection with participating in this Promotion. 

  2. These Terms and Conditions do not affect, and are not intended to affect, any rights or remedies a consumer might have which cannot be excluded under applicable consumer protection laws. 


Prize


  1. The winner will receive the following a 2-night stay at the The Meadows House on available dates of their choice between 19 March 2024 and 31 December 2024

  2. Return flights from any Australian capital city, booked by the Promoter:
  3. Flights from an Australian capital city (Sydney, Melbourne, Brisbane, Darwin, Hobart, Adelaide, Perth or Canberra) to Ballina/Byron Airport.
  4. If needing to make a change you must pay any fare difference between the fare for your new booking and the original fare.
  5. Airline choice and flight bookings at discretion of Promoter.
